The Trade Union Delegation (Delegation)

A Trade Union Delegation is set up when one or more representative employee organizations request it. However, these organizations are only entitled to nominate candidates for the election or designation of the Trade Union Delegation if they meet certain additional criteria of representativeness. The organizations must ensure that the persons nominated or the candidates for the elections are as representative as possible of the various departments of the company. If the mandate of a trade union delegate ends for any reason, the organization to which the delegate belonged has the right, in the absence of a substitute, to designate a person to terminate this mandate.

 

General authority

It is generally stated that the powers of the Trade Union Delegation relate to, among other things:

1. labor relations;

2. the negotiations with a view to concluding collective agreements or agreements within the company, without prejudice to thisan to the collective agreements or agreements concluded in other areas;

3. the application in the company of social legislation, collective labor agreements, work regulations and individual employment contracts;

4. compliance with the general principles laid down in collective bargaining agreement no. 5 of 24 May 1971.

 

In addition, the Trade Union Delegation also has the right to deal with individual and collective disputes. In connection with collective disputes, it has the right to be heard by the head of the company or his representative whenever such a dispute arises or threatens to arise at the level of the company. Individual complaints must be submitted through the normal hierarchical route by the employee concerned. However, he may be assisted by his trade union representative at his request. In addition, the Trade Union Delegation has the right to be heard in connection with any individual dispute that cannot be resolved in this way.

To guarantee employees that they can confidently submit their candidacy and express themselves freely, the legislator has provided for protection against dismissal of candidates for the social elections and elected members of the Works Council and the CPPW.
